Electronic voting 2025

Modern electronic voting for California HOAs

Official HOA Elections offers fully compliant electronic voting solutions that make it easier for homeowners to participate and for boards to administer elections.

What is electronic voting?

Electronic voting allows homeowners to cast their ballots securely online or via email, in addition to or instead of traditional paper ballots. California Civil Code permits electronic voting when certain requirements are met.

Our electronic voting platform is designed specifically for California HOA elections, ensuring full compliance with the Davis-Stirling Act while providing a convenient, modern experience for homeowners.

California Civil Code § 5105

California Civil Code requirements for electronic voting

Before your association can adopt electronic voting, the following requirements set forth by California Civil Code § 5105 must be satisfied:

1

Governing document authorization

The association's governing documents must authorize the use of electronic voting, or the membership must adopt a resolution permitting it.

2

Individual member consent

Each member who wishes to vote electronically must provide prior written consent to receive ballots and cast votes by electronic means.

3

Paper ballot alternative

Members who do not consent to electronic voting must still be provided a paper ballot. Electronic voting cannot be the sole method offered.

4

Secret ballot integrity

The electronic voting system must preserve the secrecy of each ballot and prevent association directors, officers, or employees from knowing how any member voted.

5

Authentication & security

The system must authenticate the identity of each voter and ensure that each eligible member may cast only one ballot per election.

6

Audit trail

The electronic voting system must maintain a verifiable audit trail that allows the inspector of elections to confirm the accuracy of the vote count.

7

Inspector of elections oversight

An independent inspector of elections must oversee the electronic voting process, including the receipt, custody, and tabulation of all ballots.

8

Consent revocation right

Members must be permitted to revoke their consent to electronic voting at any time and revert to receiving a paper ballot for future elections.
